I am pleased to welcome you to the Legal Affairs Department’s website which is the Department’s online window to all the visitors around the world. Through this website, we try to disseminate the Department’s mission and realize some of the Department’s objectives. The Department of Legal Affairs plays a significant role in SQU; it conducts legal studies and provides a legal opinion on matters referred to it. It also represents the University in courts and other legal forums or institutions. The Department reviews all contracts, agreements, and memorandum of understanding which the University signs with local and international institutions. The Decision Section in the Legal Affairs Department drafts and reviews various types of administrative decisions. Taking into consideration that respecting university rules and regulations is the responsibility of all stakeholders of the university and the rest of the Omani community. The Department is keen to provide and foster legal awareness and encourage the rule of law in Omani society. The Department strives to fulfill its duties and achieve its objectives, but this requires all concerned parties and stakeholders to come forward with suggestions to improve the legal services offered by the Department.

Objective

To ensure that all university practices comply with existing laws, regulations and decisions.

 

Coordination & Follow-up section  

  •   Receive and record incoming mail electronically and send outgoing mail to concerned bodies and parties following established procedures 
  •  Print letters, memos and reports referred to it by the director, his deputy or other units within the department. 
  •   Save for easy reference in separate files copies of outgoing correspondence, decisions, circulars, contracts, agreements, and memorandum of understanding. 
  •   Oversee the department’s legal library, keeping it well organized and supplied with books, reference material, circulars, and periodicals.
  •   Keep the department up to date and having required stationery in accordance with established procedures.
  • Acquire official newspapers and deposit them in the department’s library. 
  •  Supply the department’s units with official newspapers whenever necessary. 
  • Supervise the department’s folders and correspondence and protect their confidentiality. 
  •  Follow-up with concerned bodies inside and outside the university on matters referred by the department, using the form prepared for this purpose. 
  •  Reply to inquiries referred to it from other coordination and follow-up units on all issues referred to the department. 
  •  Supervise updating of the department’s website.
  •  Undertake any other tasks that are assigned.

Legal Affairs Units

Legal Studies Unit

The unit's duties are to:

  •  Prepare legal studies on issues referred to the unit by the vice-chancellor, his deputies and all other relevant parties and provide a legal opinion on them.
  •  In accordance with established procedures, investigate alleged violations by university staff.
  •  As provided by law, represent the vice-chancellor in cases filed by or against the university.
  •  Prepare litigation pleas and defense briefs in cases filed by or against the university.
  •  Participate in commissions of inquiry, keep minutes of their deliberations and protect their confidentiality.
  •  Keep minutes of investigative committee meetings together with files on all suits filed by or against the university and protect their confidentiality.
  •  Keep the record of laws and regulations for easy reference.
  •  Prepare an annual report on the unit’s accomplishments and submit it to the department’s director.
  •  Undertake any other tasks that are assigned.
Decisions & Bylaws Unit

The unit's duties are to:

  • Prepare, draft and review all decisions and circulars to ensure their compliance with existing laws and regulations and forward them in a style which facilitates approval by the vice-chancellor, his deputies and all concerned parties.
  •  Review the drafts of laws, regulations, and decisions referred to it and provide a legal opinion on them.
  • Participate in committees formed to prepare university bylaws and regulations.
  • Keep records of laws and regulations and make them accessible.
  • Prepare an annual report on the unit’s accomplishments and submit it to the department’s director.
  • Undertake any other tasks that are assigned.
Contracts & Agreements Unit

The unit's duties are to:

  •  Prepare, draft and review all decisions and circulars to ensure their compliance with existing laws and regulations and forward them in a style which facilitates approval by the vice-chancellor, his deputies and all concerned parties.
  •  Provide a legal opinion on matters referred to it concerning contracts and agreements.
  •  Keep copies of agreements, contracts, and memoranda of understanding.
  • Prepare litigation pleas and defense briefs in cases filed by or against the university where these concern contracts and agreements to which the university is a party.
  •  Prepare an annual report on the units’ accomplishments and submit it to the department’s director.
  •  Undertake any other tasks that are assigned.

Litigation Department
  • Representing the University before various types and levels of courts and arbitral tribunal in cases to be considered for and against the University as defined by the Laws.
  • Appealing against judicial decisions which the University doesn’t approve of within the mandated time frame.
  • Preparing pre-trial briefs and defense statements in cases brought before the court by or against the University.
  • Writing reports to Various Units of the University on the subjects pertaining the legal cases.
  • Following-Up the implementation of court judgment and arbitrations against the University and preparing the official letters pertaining the implementation.
  • Preparing reports on the Department tasks.
  • Any Other Tasks Assigned to the Department.
